These Terms of Service govern use of the Sand • Slopes website and any travel-planning, consultation, research, recommendation, and booking-support services provided through it.
1. Acceptance of These Terms
By accessing or using this website, submitting an inquiry, requesting travel-planning assistance, or engaging Sand • Slopes for services, you agree to be bound by these Terms of Service. If you do not agree, do not use the website or services.
2. Role of Sand • Slopes
Sand • Slopes acts as an independent travel advisor, planner, and intermediary. We do not own, control, manage, or operate airlines, hotels, resorts, cruise lines, tour operators, transportation providers, insurance providers, or other travel suppliers unless expressly stated otherwise in writing.
Our role may include research, recommendations, itinerary support, quote coordination, reservation support, and general travel guidance. Final travel services are typically supplied by third parties subject to their own terms, policies, pricing, schedules, and conditions.
3. Third-Party Suppliers and Provider Responsibility
All transportation, lodging, vacation packages, cruises, tickets, excursions, and related travel products are provided by third-party suppliers. Sand • Slopes is not responsible for acts, errors, omissions, breaches, delays, cancellations, defaults, bankruptcy, overbooking, schedule changes, quality issues, safety conditions, or failures of any supplier.
- Supplier pricing and availability may change without notice until booked and confirmed.
- Supplier rules, baggage policies, cancellation terms, and entry requirements may vary.
- You are responsible for reviewing all supplier documentation and policies provided to you.
4. Eligibility and Authority to Book
You represent that you are at least 18 years old and have legal authority to enter into binding agreements for yourself and for any traveler on whose behalf you act. If you make arrangements for other travelers, you represent that you are authorized to do so and that you will provide them with all relevant terms, policies, confirmations, and disclosures.
5. Accuracy of Information Provided by You
You are responsible for providing accurate and complete traveler information, including full legal names, birth dates, passport details, contact information, destination preferences, and any special requests. Sand • Slopes is not liable for issues resulting from inaccurate, incomplete, or delayed information provided by you.
6. Quotes, Pricing, Payments, and Authorization
Quotes are subject to change until confirmed. Pricing may change because of supplier inventory, taxes, fees, fuel surcharges, exchange rates, promotions ending, or other factors beyond our control.
- You authorize Sand • Slopes to communicate your information to suppliers as needed to research, hold, confirm, service, or support bookings.
- Payments may be processed directly by suppliers or third-party processors, not by Sand • Slopes.
- You are responsible for reviewing invoices, confirmations, traveler names, dates, destinations, and charges before approving payment or booking.
- Any separate planning, consultation, service, or research fee charged by Sand • Slopes, if applicable, may be non-refundable unless otherwise stated in writing.
7. Cancellations, Changes, and Refunds
All cancellations, changes, credits, and refunds are governed primarily by supplier rules. Many travel products are non-refundable or subject to penalties. Sand • Slopes does not guarantee refunds, credits, waivers, or exceptions from suppliers.
If you request changes after booking, additional supplier fees, fare increases, reissue fees, service fees, or penalties may apply. You are responsible for all such amounts.
8. Travel Risks and Assumption of Risk
Travel involves inherent risks, including but not limited to delays, missed connections, cancellations, illness, injury, theft, crime, weather, natural disasters, strikes, labor disruptions, political instability, public-health events, border restrictions, supplier insolvency, and acts of third parties.
By using our services, you knowingly and voluntarily assume all risks associated with travel and related activities. Sand • Slopes is not responsible for losses, injuries, damages, expenses, inconveniences, or disruptions arising from such risks.
9. Travel Insurance Recommendation
Sand • Slopes strongly recommends that all travelers purchase comprehensive travel insurance, including cancellation coverage, interruption coverage, medical coverage, evacuation coverage, baggage coverage, and other protections appropriate to the trip.
If you decline travel insurance, you understand and accept the risks of uninsured losses, and you waive claims against Sand • Slopes for losses that could have been covered by insurance.
10. Travel Documents, Entry Requirements, and Compliance
You are solely responsible for obtaining and carrying all required travel documents and satisfying all entry, transit, health, customs, vaccination, visa, passport, re-entry, and identification requirements. Requirements can change at any time, and it is your responsibility to confirm them directly with the appropriate authorities and suppliers.
Sand • Slopes is not liable if you are denied boarding, denied entry, removed from a destination, delayed, or otherwise affected because of documentation or compliance issues.
11. Traveler Conduct
You agree to act lawfully and respectfully in connection with the website, our services, and your travel arrangements. You are responsible for your own conduct and the conduct of all travelers in your party. Supplier-imposed removal, denied boarding, or penalties resulting from misconduct are your responsibility.
12. Website Use Restrictions
- You may not misuse the website, attempt unauthorized access, interfere with site operations, or use the website for unlawful purposes.
- You may not copy, scrape, reproduce, distribute, republish, or commercially exploit site content without written permission.
- You may not upload harmful code, attempt to disrupt services, or use automated methods to interfere with the site.
13. Intellectual Property
All content on the website, including text, branding, design elements, graphics, layouts, images, logos, and original materials, is owned by or licensed to Sand • Slopes and is protected by applicable intellectual-property laws. No rights are granted except as expressly stated in these Terms.
14. Disclaimer of Warranties
The website and services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Sand • Slopes disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and uninterrupted service.
We do not warrant that the website will always be available, error-free, secure, or free of harmful components, or that supplier information will always be complete, current, or accurate.
15. Limitation of Liability
To the fullest extent permitted by law, Sand • Slopes and its owners, affiliates, contractors, representatives, and service providers shall not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or similar damages, including loss of enjoyment, loss of opportunity, lost profits, lost savings, lost data, emotional distress, or travel disruption.
Without limiting the above, Sand • Slopes is not liable for acts or omissions of suppliers, force majeure events, travel interruptions, government actions, documentation issues, health events, weather, theft, accidents, injuries, or itinerary changes.
16. Liability Cap
To the fullest extent permitted by law, the total aggregate liability of Sand • Slopes for any claim arising out of or relating to the website or services shall not exceed the greater of: (a) the amount of any direct service fees actually paid by you to Sand • Slopes for the specific service giving rise to the claim, or (b) one hundred U.S. dollars (US $100), if no direct service fee was paid.
17. Indemnification
You agree to defend, indemnify, and hold harmless Sand • Slopes and its owners, affiliates, contractors, representatives, and service providers from and against all claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:
- Your use of the website or services.
- Your travel arrangements, activities, or conduct.
- Your breach of these Terms.
- Information you submit that is inaccurate, incomplete, or unauthorized.
- Any dispute between you and a third-party supplier or traveler in your party.
18. Chargebacks and Payment Disputes
You agree to contact Sand • Slopes in good faith before initiating any chargeback, dispute, reversal, or similar payment claim relating to services coordinated through us. Improper or fraudulent chargebacks may result in cancellation of services, loss of travel arrangements, collection efforts, or legal action where permitted.
19. Force Majeure
Sand • Slopes shall not be liable for any failure, delay, loss, cancellation, or change arising from causes beyond its reasonable control, including acts of God, severe weather, fire, flood, earthquake, pandemic, epidemic, government action, war, terrorism, civil unrest, labor disputes, supplier shutdowns, transportation interruptions, communication failures, cyber events, or similar events.
20. Suspension or Termination
We may suspend or terminate access to the website or decline service at our discretion if we believe a user has violated these Terms, acted abusively, engaged in fraud, created unreasonable risk, or interfered with operations, suppliers, or other travelers.
21. Dispute Resolution and Arbitration
To the fullest extent permitted by law, any dispute, claim, or controversy arising out of or relating to these Terms, the website, or services provided by Sand • Slopes shall be resolved by binding individual arbitration rather than in court, except that either party may seek relief in small claims court for qualifying claims or seek temporary injunctive relief where legally permitted.
You waive any right to a jury trial and any right to participate in a class action, class arbitration, consolidated proceeding, or representative action to the maximum extent permitted by law.
22. Governing Law and Venue
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. If arbitration is found unenforceable for any matter, you agree that exclusive jurisdiction and venue shall lie in the appropriate state or federal courts located in New York, to the extent permitted by law.
23. Changes to These Terms
We may revise these Terms from time to time by posting updated terms on this page. Updated terms become effective when posted unless a later date is stated. Your continued use of the website or services after changes are posted constitutes acceptance of the revised Terms.
24. General Provisions
- If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force.
- Failure to enforce any provision is not a waiver of that provision.
- These Terms, together with any written booking or service terms provided to you, form the entire agreement between you and Sand • Slopes regarding the subject matter addressed here.
